If any environment-related trade dispute takes place, there are two ways to resolve it : one is through MEA, and the other is WTO Understanding on Rules and Procedures Governing the Settlement of Disputes. To prevent any possible conflicts between the two, the WTO Committee on Trade and Environment is required to define the relationship of the two norms clearly.
The case study of environment-related trade disputes shows that the argument of valuing environment has been accepted widely, and such disputes are brought to a settlement mostly by WTO Understanding on Rules and Procedures Governing the Settlement of Disputes than by MEA.
There is a tendency to interpret Article 20 of GATT, an exceptional free trade regulation for the sake of environmental protection, in more eased way. The example is Clause (b) and (g) of that article, which specify about trade regulation for the protection of life or health of human, animal and plant and measures for the conservation of limited natural resources respectively. It's currently interpreted that any action 'relating to' the measures speculated in those clauses should primarily aim for the conservation of limited natural resources and go along with domestic regulations if they are implemented 'in conjunction with' the restriction of domestic production or consumption. This is an evidence that environment is increasingly gaining in importance. As environmentalists have a greater voice in environment-related trade than free traders, it's needed to pay more attention to environment.
