The aim of this report is to expand the recognition of the crime of the counterfeit medicines between Korea and China and to enlarge the mutual understanding about the criminal situation.
There are many cases about the counterfeit medicines related with the treatment of sexual dysfunction, the improvement of sexual capacity and herbal medicine between two countries. The counterfeit medicines are transported by many peddler or some criminals who taking a ship for evading the inspection of the customs. Chinese authority is aware of the seriousness of the counterfeit medicines and trying to build up the co-operational mechanism among national organization like police, prosecutor and related public official.
The amount of crime and the ways of counterfeit medicines are various and evolutionary, the technical development for the inspection of the counterfeit medicines is also progressive for the prevention of the counterfeit medicines.
The amount of crime related to counterfeit medicines is varied and the criminals who are related with the crime are also very different in each case. It is necessary to make diverse punishment with broad variety of fine according to the various situation of the counterfeit medicines, but it is required to abolish the death penalty of the crime of the counterfeit medicine because the crime can not be eradicated through the death penalty.
The crime of counterfeit medicines is transnational, organized and co-operational among the countries closed to each other. It is necessary to have common countermeasure structure or consultative group for the policy and the plan for reaction in each country. The close co-operation and prompt sharing system of the information related with the counterfeit medicine and the related criminals is important to prevention of the counterfeit medicine between two countries.
It is necessary to increase the co-operation and the mutual understanding among China, Korea and Japan because they encounter the same problems and face the similar threat including the crimes of the counterfeit medicines from one another, the stable regional community in East Asia can be accomplished through the exchanging the viewpoints, the consecutive understanding from each other and the trying to get the common goal that can be empathized.
