Prosecutor’s power of Korea is so strong that we can not find similar powerful prosecutor in all nations. Korean prosecutor has all powers in criminal justice system except judge of court. Korean prosecutor has investigation of crimes, supervising police investigation of police, prosecution to criminal court, operating criminal action in court, enforcement of criminal sanctions.
There is no check and balance system to this overpower of Korean prosecutor. Any government agency can not check overpower of Korean prosecutor like his own way one-side criminal investigation, unfair target criminal investigation, unjustice taking part criminal investigation etc.
Korean prosecutor tend to conspire with political power to extend power and money of each other. The political power approve overpower of prosecutor to exempt his crimes such as bribe, illegal political overpowering etc. On the one hand prosecutor enjoy his overpower in taking money, illegal overpowering of criminal investigation and prosecution etc.
As result of black connetion of political power and prosecutor’s power, corruption of politics, economy system, social system and criminal investigation etc. The people of nation tremble with fear of illegal enforcement of investigation agencies. But a few people who have political and rich power are excepted from legal enforcement.
So we have to do two-ways solution of prosecutor’s illegal overpowering system. First, prosecutor’s power has to be reduced. In criminal investigation the prosecutor and the police have to be separated. Second, rational check and balance system has to be prepared. By this two-ways solution healthy and right nation has to be constructed.
