A 76-aged woman suffered serious brain damage caused by hypoxia during pulmonary tumors biopsy in a general hospital. She didn't recover consciousness for several months in PVS. Her family requested the hospital for the withholding of life-sustaining treatment, but the hospital refused. They filed a civil action against the hospital for the removal of artificial respiration system. 2009. 5. 21. the Supreme Court of Korea decided for the plaintiffs. It was the first case in Korea for the withholding of life-sustaining treatment for a PVS patient. By Court's opinion, the withholding of life-sustaining treatment for a PVS patient is lawful only when the case meets the following requirements. First, the patient is in a reversible step to death. The reversible step to death must be decided only when her or his unconsciousness is unrecoverabl, she or he is incurable and hopeless, and she or he is expected to die in short term. Second, the patient indicated the advance directives for the withholding of life-sustaining treatment. Otherwise, at least, the patient's will would be presumed through her or his words, writings, character, religious faith, responses to other PVS cases, ages, side effects and sufferings caused by the treatment. The Court's decision removed the unstableness of law about the withholding of life-sustaining treatment for a PVS patient. But I think that the requirement of the expectation of death in short term in the Court's opinion is too rigid.
